We are experienced in a variety of forms of alternate dispute resolution (“ADR”), including mediation. In mediation, we do not act as judges or representatives of one party. Instead, we act as confidential and neutral facilitators, assisting parties in resolving their disputes, which may or may not already be in active litigation in the federal and state courts. Judge Brown practiced law before becoming a bankruptcy court trial judge, where he served for 19 years. Mr. Ahern was in private practice in major law firms for 40 years and is a Rule 31 certified mediator in Tennessee. We have limited our practice, so we no longer represent the parties themselves, but we have extensive past experience in such engagements, so we can understand the concerns of the parties. Our experience includes resolution of complex bankruptcy and commercial litigation involving multiple parties.
Examples of such work that we have done include:
- serving as a mediator in a complex family land dispute in bankruptcy…
- serving as a mediator in a bankruptcy court lawsuit involving the rights of parties to a forged check…
- serving as a mediator in business litigation in Florida between a major national lender and a Chapter 11 debtor…
- serving as a mediator in complex agricultural litigation at the core of a large Chapter 11 case in Texas, involving dozens of plaintiffs and defendants…
- representing the defendant in mediation of a complex state court lawsuit arising out of a purchase of property out of a Chapter 11 case…
- representing the plaintiff in mediation of a multi-party bankruptcy court lawsuit, including one of the “Big Three” automakers, arising out of an auto product failure that resulted in a Chapter 11 filing…
